FACT, E-OSCAR and Inaccurate Credit Reports PDF Print E-mail

With the 2003 amendments to the FCRA, and the introduction of the FACT Act, millions of consumers will see the quality of their credit reports degrade even further.

FACT stands for Fair and Accurate Credit Transaction Act, but in reality it is just our government trying to appease millions of consumer who complain about the current credit reporting industry. 

But they are only appeasing us in "name" only, because the Act itself will be causing all of us big problems.


Medical Information

Have you ever looked at you credit report and wondered who the heck is that business?  It may be a tradeline or it may be an inquiry that occurred.  With all the mergers, sell-offs (like JC Penneys sold their entire card services to MBNA) and corporate affiliations, you can no longer tell who these businesses are.  You maybe able to guess by the dollar amount or by the dates, but you have to play Sherlock Holmes to figure it out.

Well one would think that in developing the FACT Act that our federal government would address this problem.  Well we're wrong.  Instead of making it easier, their about to make it harder for us all.

Now when it comes to medical accounts the national CRA's aren't even going to provide us the names of the creditors.  Even if the name of the credit grantor implies something medical, the CRA are going to place the word "MEDICAL" in lue of the credit grantor's name.

Therefore, if you have a good account with Tom's Medical Supplies, there is a chance that the word "MEDICAL" will replace the name.

So much for the word ACCURATE.

What is even worse, if you try to seek help from a re-seller to determine who this is on your credit report - they won't be able to tell you. (We haven't really figured out who will be able to tell you yet). Because the software the national CRA's use provide to disclose this information will no longer provide ANYONE with the name or address or telephone number of medical accounts.

So, when you go to try to get something resolved because of inaccurate information, good luck.  Now on medical accounts you will be forced to deal directly with the national CRA's.  And as everyone know, "the lights maybe on but you never find anyone home."

So much for the word FAIR.

E-OSCAR

E-OSCAR is an automated consumer dispute verification (ACDV) process.  The national CRA's are demanding that everyone who provides information to them be on this system.  If you don't get on the system, you CAN NOT provide information to a national CRA.

Now no one is against getting disputes resolved in a timely manner, but it has been our experience that E-OSCAR doesn't do that. 

For years the major credit grantors have been doing automated dispute verification.  Yes it's quick but it is also extremely inaccurate.

Have you ever seen your credit report merged with anothers?  Have you ever seen wrong information on your credit report that you can prove is wrong?  Have you sent information regarding a dispute to the CRA's only to have the incorrect information remain on your credit report?  Well, you have E-OSCAR to thank for that.

With E-OSCAR the national CRA's NEVER send to the original creditor the information you provide them. It has a very limited summary of the problem.  You are at the mercy of some lowly clerk who is scanning your letter, along with hunderds of others, trying to determine what to say in 30 words of less.  And the documentation you sent which proves your point, what happens to that?  It gets filed away, incase you should sue them.  Or maybe it gets shredded in case you sue them.  Either which way, it isn't used.

So much for the word FAIR.

To make matters even worse, the CRA's have taken it upon themselves to start charging creditors for this worthless piece of work.  And to top it off, smaller creditors who use to supply information to your credit report manually, well, they are now shut off all together.  These creditors will no longer be able to provide Universal Data Forms.

Not only that, but smaller creditor who are unable to link to E-OSCAR or those unwilling to pay will most likely just stop reporting any information.

Statistically, over 93% of all information supplied by creditors is positive information.  Information that shows you are a good credit risk. Information that helps your point scores. Now all this information is being tossed out - not accepted. Thanks to the FACT Act.

So much for the word ACCURATE.

The FACT Act is the greatest destruction of the FCRA that we have seen in a long time.  Our federal government should be ashamed.

I wish we had an automated system that would allow you to complain to your U.S. Representatives about this, but the best that we can do is provide a link to them.

slander?

Written by vergie on 2005-01-01  my local circit court sent my name to a collection agancy because someone with a close name did not pay a ticket. I have told the three credit b's that its not me. they first said that it would be removed that was months ago. my score is so low cause of collections put on my report that no one wants to do business with me. what can i do to get them to get off there duff and correct the problems?

Written by cat101 on 2005-01-07  The bureaus are protected from mistakes made by creditors/data furnishers. However, they are to "permanently" remove items that are not yours. The data furnishers are to correct items that are wrong. Try contacting the collection agency & getting them to correct it.  
 
If that doesn't work file a complaint with your state attorney general.

Written by cat101 on 2005-07-26  Normally, you'll only see very new account with the word "Unrated".  
 
Rating occurs based on how you pay the account. If you pay on time, it is rated a 1. If you are 30 days past due, it is a 2. 60 days past due is a 3. The worst rating is a 9. 
 
This is neither good or bad. 

NOT FAIR!!!!!!!!

Written by Guest on 2005-09-24  I have a good standing account with the state of Idaho for child support. Because they are so backed up on paperwork from dead beat parents they automatically assume that I am one of them. So they decided to report me to the CRA's. Even though it is in good standing, I do not want that info on my report-because I KNOW that they will screw up as usual and report something bogus. I am fighting to get this removed, what options do I have?

Written by cat101 on 2005-09-26  How did they report it? Usually they only report those that are behind. Depending on what is on your credit report, determines the steps. You can private message us via our "contact us" page.

Frustrated!!!

Written by Guest on 2005-10-07  I am a 19 year old student and Experian has reported incorrect information concerning my credit. I lost my 3000.00 student loan. I have sent 2 certified letters and many phone calls to no avail. What are my options?

Who reported you to Experian? The first thing that you may want to do is contact whoever filed the report and get a letter from them. After that, then go back to Experian, armed with your evidence. 
 
If the party reporting you will not provide you with a letter stating the you have been reported in error, then you need to do a couple of things. First, check to make sure that you are not a victim of identity theft. You'll need to pull your credit report for this. 
 
Second, if you are not an ID theft victim, file a complaint with the FTC naming both Experian and the party who filed the false report. Do the same thing with your state attorney general. By law, Experian has to remove false information from your credit report. Also, it is against the law to file a false report with a CRA such as Experian.

It's Crazy

I was amazed because i didn't have any credit , but I found out I had medical bills on my credit report. I wondered how is that when I have insurance through my job and they suppose to pay for it. Now I have to fix everything due to laziness from my last employer.

Written by cat101 on 2005-11-01  Usually collection items (which is the usually way medical bills get on a credit report) do not affect point scores as much as one would believe. Your statement "I didn't have any credit," is most likely the primary reason for the low score.  
 
Getting financing from a car dealership can be another reason for low scores, they place numerous hard inquires on your credit report that causes lower point scores. 
 
The best thing to do is talk to the banker where you have your checking account. See what they can qualify you for.  
 
You may also want to get a gas card. These are usually low balance card & hard to get into trouble with.

Credit reporting Error

Written by flexplayer on 2005-12-18  Ford Credit sent a 30 day late to all 3 agencies, I was never late, and I called them, they said they would fix it, and report it to the agencies, what can i do at this time?

2credit files and two different scores w

Written by Guest on 2006-02-22  I recently requested my credit files to review and update before applying for a mortgage and to my dismay equifax gave out a very low score of 564 when a trimerger credit report was pulled, the very next day it was pulled by another lender individually and they recieved two scores from equifax 564 and 640 . I called them to ask what is going on ?? They claim my file is to large for one file so they split it up and created two files.The problem is how they are giving my scores out ?? Who has the right to play god and send the low score on a trimerge credit report, let alone have two scores sent out when someone pulls a equifax report.I have faxed a request to equifax to combine my files ,as well as put it in writing and sent it certifide, spoken to over 5 supervisors, and more then 8 other employees and keep getting the run around . What legal action can be taken this is hurting my offers for a mortage ??

I've seen files that run for over twenty pages - never seen them split unless there is basic facts that do not match, such as SSN, DOB, Name, etc. That maybe the case here. 
 
As for scores, the fact is -- you have THOUSANDS of credit scores. The one YOU purchase is NOT the one creditors us. Also on a trimerge there should of been three scores.

The sale of loans is a routine matter. The comment is informational only and should have no bearing on your credit report.

Written by cat101 on 2006-04-12  This comment is actually a code that is sent to the national CRA's by the creditor. There are many codes representing many situations - ie. Paid after write off, In Bankruptcy, Closed by Creditor, etc. 
 
And yes, certain codes can effect your credit report (such as paid after write off).  
 
In this situation, since it is considered a "good trade", it will remain on your credit report forever. However, the positive effect will begin to fade as it gets older.

Some company hit me har

Written by Edster32 on 2006-05-09  They got money out of my bank account and then opened up an account for me. Now I caled them as soon as I notice money was missing out of my account with a bank specialist on the line with me.I told them that I did not want their account.or anything to do with them. yet6 years later I find this company list on my credit report saying I haven't paid them for this account. It was some type of catalog company. What should I do?

WRONG PERSON ADDED TO MY CREDIT REPORT

Written by Guest on 2006-06-14  A PERSON HAVING CLOSE TO THE SAME NAME AS MINE, DIFFERENT ADDRESSS, SS#, ETC...HAS BEEN ADDED TO MY CREDIT REPORT BY EXPERIAN. 
THIS HAS LOWERED MY SCORE DRASTICALLY. WHAT ARE MY OPTIONS?

Written by cat101 on 2006-06-15  Dispute the information with the CRA in writing. Regretfully, this is a common mistake "Thanks to Automation." Anyway, I say to do it in writing because there is a very good chance that they won't correct it. 
 
The number of times we have helped Smith's that live in the same area deal with "merged reports" is too many to count! 
 
You have to start with the dispute. Of you got a wrong name, there is a good chance that you also got their trade lines. Those need to be disputed too. You should also have a 2nd SSN and possibly a 2nd spouse. All those need to be detailed in your dispute. 
 
The CRA will then "verify the debt", which does nothing to resolve the problem because they don't tell the creditor everything that you provided. BUT you must start there. 
 
When they don't correct it, the next letter is to your state attorney general. Attach all documentation & also include the trade lines that verified that the accounts were yours. 
 
That should solve the problem.

trying to rent

Written by sweety on 2006-06-18  Im in the process of looking for an apartment and they all want to do credit checks. I just checked my report and score. And it went down because Midland Credit Mgmt is on there twice for the same account. Will that affect their decision to rent to me?

Written by cat101 on 2006-06-19  It is hard to say if it will affect their decision. Some landlord will merely charge a larger deposit. What they do with the information is based on their procedures - which are internal.
